1. Acceptance of Terms

Fencer IQ is a product of EXADreams LLC. By creating an account or using Fencer IQ ("the Platform"), you agree to these Terms of Service with EXADreams LLC ("the Company"). If you are registering on behalf of a minor, you confirm that you are their parent or legal guardian and accept these terms on their behalf.

2. Description of Service

Fencer IQ, operated by EXADreams LLC, provides an assessment and development platform for competitive fencers. The Platform includes:

• Self-assessments and multi-perspective evaluations (athlete, coach, parent).
• AI-generated growth plans and adaptive follow-up questions.
• Performance tracking: progress charts, journal, goals, competitions, and weekly check-ins.
• Monthly progress report cards.
• Direct and group messaging between coaches, athletes, parents, and clubs.
• Training planner with session scheduling and drill library.
• Custom drill creation for coaches.
• Roster management and bulk CSV import for coaches and clubs.
• Club branding and team management tools.
• On-device video analysis (Lunge Analysis) using your device camera and MediaPipe pose detection for technique feedback.
• Media Analysis — AI-powered video technique review using the SaFE Vision Engine, governed by the separate Media Analysis Agreement.
• AI chatbot (Wolfy) providing conversational coaching insights using your training data and assessment history.
• Voice assistant (Wolfy) for hands-free platform navigation using your device microphone.
• Coach competition review with structured feedback and action items.
• Tournament browsing via AskFred integration for discovering upcoming competitions.
• Coach-assigned activities and tasks with descriptions, due dates, and completion tracking.
• Digital Fencer ID cards with QR-based public membership verification.

2a. Device Permissions

Certain features require access to device hardware. The Platform will request your explicit permission before activating any of the following:

• Camera: The Lunge Analysis feature uses your device camera and Google MediaPipe pose detection to track 33 body joints in real-time. All video processing occurs entirely on your device — no video or image data is uploaded to our servers or sent to any third party. Camera access can be revoked at any time through your device or browser settings.
• Microphone: The Wolfy Voice Assistant uses your device microphone to capture spoken commands. Audio is converted to text on-device or via your browser's speech recognition API, and only the resulting text transcript is sent to our servers for processing. Raw audio is never stored or transmitted. Microphone access can be revoked at any time through your device or browser settings.

3. Accounts and Eligibility

You must provide accurate information when creating an account. Each person should have only one account. Coaches and parents must have a legitimate relationship with the athletes they are connected to on the Platform. Accounts for athletes under 13 must be created by a parent or guardian.

Health data for minors: Collection of health-related data (date of birth, height, weight, physical or mental considerations) from users under 13 requires verifiable parental consent. Parents must actively opt in to health data collection for their child through a dedicated consent flow. By default, health data collection is disabled for all users under 13.

3a. Health & Physical Data

Fencer IQ may collect optional health-adjacent data — including date of birth, gender, height, weight, physical limitations, and mental considerations — solely for the purpose of personalizing training recommendations. By providing this data, you acknowledge and agree that:

• This data requires separate explicit consent and can be withdrawn at any time through the Settings page.
• Health data is advisory input only — Fencer IQ does not provide medical advice, diagnosis, or treatment.
• You must consult qualified medical professionals before following any exercise recommendations, especially if you have disclosed physical or mental limitations.
• Fencer IQ and EXADreams LLC are not liable for injuries or adverse effects resulting from following training plans, whether or not health data was provided.

HIPAA Disclaimer: Fencer IQ is not a healthcare provider, health plan, or healthcare clearinghouse. EXADreams LLC is not a HIPAA-covered entity. The health-adjacent data you provide (height, weight, physical limitations, mental considerations) is collected solely for athletic training personalization and is not protected health information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA). If you require medical care or mental health treatment, please consult a licensed healthcare professional.

4. AI-Generated Content Disclaimer

AI-generated growth plans, follow-up questions, and recommendations are for informational and educational purposes only. They are not a substitute for professional coaching, medical advice, sports science guidance, or individualized athletic training programs. Fencer IQ and its AI systems:

• Do not diagnose injuries, medical conditions, or psychological disorders.
• Do not replace the judgment of qualified coaches or sports professionals.
• May produce recommendations that are not appropriate for every athlete's specific circumstances.
• Should be reviewed by a qualified coach before implementation.

You use AI-generated content at your own discretion and risk. Fencer IQ is not liable for any injury, harm, or adverse outcome resulting from following AI-generated recommendations.

AI Chatbot Interactions: When you use the Wolfy Chatbot, your training session history, goals, assessment scores, and other athlete context data are sent to Anthropic Claude AI to generate relevant responses. This data is processed in real-time and not retained by Anthropic. See our Privacy Policy for full details on AI data processing.

90-Day AI Growth Plans: Fencer IQ generates personalized 90-day training plans using your assessment scores, goals, competition history, and (if consented) health-adjacent parameters. These plans are generated by Anthropic Claude AI and should be reviewed by a qualified coach before implementation. Plans are regenerated as new assessment data becomes available.

5. Messaging and Communication

The Platform provides direct and group messaging between connected users. By using messaging, you agree to:

• Communicate respectfully and appropriately with all users, including minors.
• Not send spam, unsolicited promotions, or harassing content.
• Not share another user's personal information without their consent.
• Report inappropriate messages to support@fenceriq.ai.

We reserve the right to review messages in response to reports of abuse and to suspend or terminate accounts that violate these guidelines.

6. User-Generated Content

You may upload content to the Platform including profile photos, journal entries, media (photos and videos), custom drills, and messages. By uploading content, you:

• Confirm that you own the content or have permission to use it.
• Grant Fencer IQ a license to store and display the content within the Platform as necessary to provide the service.
• Agree not to upload content that is illegal, harmful, offensive, or violates the rights of others.
• Accept that uploaded media is stored securely but shared with connected users as part of the Platform's features.

We reserve the right to remove content that violates these guidelines.

6a. Fencer ID Cards and Public Verification

Fencer IQ issues digital Fencer ID cards containing a unique member identifier (FIQ-XXXXXXXX) and a QR code. By accepting a Fencer ID card, you acknowledge that:

• The QR code links to a public verification page accessible to anyone who scans it, without requiring a Fencer IQ account or login.
• The public verification page displays: your first and last name, weapon, club affiliation, and current membership status.
• This information is intentionally public to allow tournament organizers, referees, and other fencers to verify your identity and membership.
• You may request removal of your public verification page at any time by contacting support@fenceriq.ai. This will deactivate your Fencer ID card.

7. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose.
• Attempt to access other users' data without authorization.
• Manipulate assessment scores or data.
• Use automated tools, bots, or scripts to access the Platform.
• Abuse the AI plan generation feature (excessive or automated requests).
• Impersonate another person or misrepresent your role (coach, parent, athlete).
• Upload malicious files, viruses, or harmful content.
• Circumvent security measures or row-level access controls.
• Upload CSV files containing personal data of individuals without their knowledge or consent.

8. Intellectual Property

The Fencer IQ platform, assessment questions, scoring algorithms, SaFE AI engine, drill library, and branding are the intellectual property of EXADreams LLC. Your assessment data, journal entries, custom drills, and AI-generated plans belong to you, but we retain a license to use anonymized, aggregated data to improve the Platform and train the SaFE AI engine as described in our Privacy Policy.

8a. SaFE AI Engine

Fencer IQ develops a proprietary AI engine called SaFE designed specifically for fencing development. By using the Platform, you acknowledge that:

• Anonymized, aggregated platform data (with all personal identifiers removed) may be used to train and improve the SaFE engine.
• This data never leaves Fencer IQ's infrastructure. No third party receives training data.
• You may opt out of contributing to SaFE model training at any time via Settings without losing access to any features.
• The SaFE engine and all models derived from platform data are the intellectual property of EXADreams LLC.
• Insights generated by the SaFE engine are advisory only — the same disclaimer as Section 4 (AI-Generated Content) applies.
• Health data (height, weight, physical or mental limitations) is anonymized before being used in any AI processing. Raw health data is never sent to third-party AI providers — only derived training parameters (e.g., "reduce intensity", "exclude high-impact drills") are included in AI prompts.

9. Email Communications

By creating an account, you consent to receive transactional emails including:

• Email verification and password reset links.
• Invitation notifications (coach, parent, athlete connections).
• Monthly progress report emails (sent to parents by coaches).
• Account-related notifications (password changes, security alerts).

You may opt out of non-essential notifications through the Settings page. Transactional emails required for account security cannot be disabled.

10. Billing and Subscriptions

Fencer IQ is currently in beta and free for all users. When paid plans are introduced:

• Subscription pricing and features will be clearly communicated before any charges.
• Payment processing is handled by Stripe. We do not store credit card details.
• You may cancel your subscription at any time. Access continues until the end of the billing period.
• Refunds are handled on a case-by-case basis by contacting support@fenceriq.ai.

11. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your data, including special protections for minors' data.

12. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Platform may experience downtime for maintenance, updates, or unforeseen issues. AI features depend on third-party services and may be temporarily unavailable.

13. Limitation of Liability

Fencer IQ is provided "as is" without warranties of any kind. To the maximum extent permitted by law, EXADreams LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to athletic performance outcomes, competition results, or training injuries.

13a. Training Recommendation Disclaimer

Training plans generated by Fencer IQ — whether template-based or AI-customized — are general fitness guidance intended for fencing development. They are not a substitute for professional coaching, medical advice, or physical therapy. By using any training features, you acknowledge and agree that:

• You assume responsibility for assessing your own physical fitness and readiness before following any training plan or drill recommendation.
• You should consult a qualified medical professional, coach, or physical therapist before beginning any exercise program, particularly if you have existing injuries, health conditions, or disclosed limitations.
• EXADreams LLC and Fencer IQ disclaim all liability for injury, illness, or adverse effects arising from following platform-generated training recommendations, whether or not health data was provided.
• Coaches using Fencer IQ's tools to create or assign training plans remain independently responsible for the suitability of those plans for their athletes.

14. Media Analysis Feature

The Media Analysis feature allows users to upload video clips for AI-powered fencing technique analysis. Use of this feature is governed by the Media Analysis Agreement, which covers technology limitations, acceptable use, data handling, subscription quotas, and liability. By using Media Analysis, you agree to the terms in that agreement in addition to these Terms of Service.

Key points: uploaded videos are processed by third-party AI services, stored for up to 90 days, and results are retained as part of your development history. Uploading video of minors requires explicit parental or guardian consent. Full details are in the Media Analysis Agreement.

15. Account Termination

You may delete your account at any time through the Settings page. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

16. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email. Continued use after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of Collin County, Texas.
